Overview

DropSub LLC ("DropSub", "we", "us") takes copyright infringement seriously. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and have implemented a policy to respond to valid notices of copyright infringement from rights holders or their authorized agents.

This document explains how to file a takedown notice, what information is required, and what you can expect from us in response.

What is the DMCA?

The Digital Millennium Copyright Act is a United States copyright law that provides a framework for copyright holders to request the removal of content that infringes their rights from online services. It also protects online service providers from liability for content posted by their users, provided the service provider acts expeditiously to remove infringing content upon receiving a proper notice.

DropSub is a storage and distribution platform for artist content. Artists upload their own work — photos, videos, audio, documents — and provide fan access through subscription tiers. We do not create, edit, or own the content stored on our platform.

Our Copyright Policy

DropSub's platform is built for artists to share and monetize their own creative work. By accepting our Terms of Service, every artist certifies that they own or hold the necessary rights to any content they upload.

Despite these safeguards, infringing content may occasionally appear. We will respond promptly to valid DMCA takedown notices. If you believe content on DropSub infringes your copyright, please follow the process described below.

Important: Filing a false or misleading DMCA notice can expose you to legal liability for damages, including costs and attorneys' fees. Only file a notice if you have a good-faith belief that the content is infringing.

How to Submit a Takedown Notice

Required Information

A valid DMCA takedown notice must include all of the following elements (17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  • Identification of the material on DropSub that is claimed to be infringing, with enough detail for us to locate it (e.g., the URL of the folder or file).
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Notices that are materially incomplete may not be actioned. We may request additional information if your notice is unclear.

How DropSub Responds

Upon receipt of a valid DMCA takedown notice, we will act expeditiously in the following sequence:

Review
We verify that the notice includes all required elements and that the identified content is accessible on our platform.

Disable access
We disable public access to the identified content while the dispute is pending. The content is not permanently deleted immediately.

Notify the uploader
We notify the artist (uploader) that their content has been subject to a DMCA notice, without revealing your personal contact information. We provide them information about filing a counter-notice.

Counter-notice window
The uploader has 10–14 business days to submit a counter-notice if they believe the takedown was improper.

Resolution
If no counter-notice is received, the content is permanently removed. If a valid counter-notice is received, we may restore the content after notifying you, unless you inform us that you have filed a court action to restrain the uploader.

Counter-Notices

If your content was removed in response to a DMCA notice and you believe the removal was in error (e.g., you own the rights, the use is licensed, or the use is covered by fair use), you may submit a counter-notice to legal@dropsub.com.

A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the content that was removed, and its location on DropSub before removal.
  • A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district in which DropSub may be found if your address is outside the United States), and that you will accept service of process from the person who provided the original takedown notice.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the content.

Repeat Infringers

DropSub maintains a policy of terminating the accounts of users who are found to be repeat infringers. An account may be suspended or terminated if we receive multiple valid DMCA notices relating to content uploaded by the same account, even if counter-notices are filed, and we determine in our reasonable discretion that the account holder is engaging in a pattern of infringing activity.

Repeat infringers will be permanently banned from creating new DropSub accounts. We reserve the right to escalate cases to relevant law enforcement or rights-holder organizations.

Good Faith Requirement

The DMCA provides remedies for knowingly materially misrepresenting that content is infringing (17 U.S.C. § 512(f)). If you knowingly misrepresent in a notification that material or activity is infringing, you may be liable for any resulting damages, including costs and attorneys' fees incurred by us or the accused infringer.

Before filing a notice, please consider whether the content may be covered by a license, fair use, or other exception. We take abuse of the DMCA process seriously and reserve the right to forward notices to the uploader in their entirety, including your contact details, as required by law.
